TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESEARCHKAR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING INVESTMENT LOSSES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) INR 1,000 (ONE THOUSAND INDIAN RUPEES) OR USD 12 (TWELVE US DOLLARS), OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, IF ANY.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law provisions.
Any dispute arising from or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If not resolved within 30 days, the dispute shall be submitted to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in Bengaluru, Karnataka. The language of arbitration shall be English.
If you access the Platform from outside India, you do so at your own initiative and are responsible for compliance with your local laws. Nothing in these Terms limits your statutory rights under the consumer protection laws of your country of residence.
To the extent permitted by applicable law, you waive any right to bring or participate in any class action, collective, or representative proceeding against ResearchKar.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions continue in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and ResearchKar with respect to the Platform and supersede all prior agreements and understandings.
We may update these Terms at any time. We will notify you of material changes by updating the "Last Updated" date and, where required by law, by email or in-app notice. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms.
